Qualifications
Anyone wishing to buy or lease a property must have permission
from the Minister of Housing. The Minister will give consent if the
right type of qualifications are held. The Law sets out a number of
different ways to gain qualifications.
Jerseyborn - Regulation 1(1)(a)
Jerseyborn people who have lived a total of ten years in Jersey
may rent at age sixteen, and buy from the age of eighteen. There is
no restriction on the type of property and qualifications can never
be lost eg. after time spent outside the island.
Non-Jerseyborn - 10 years residence - Regulation
1(1)(f)
People who have lived continuously in the Island for 10 years up
to the date of application will be given qualifications. These
qualifications will be lost if they leave the Island for a period
of more than 5 years.
Children of qualified people - Regulation
1(1)(h)
Children who arrive in the Island before their twentieth
birthday, and whose parent(s) are Jerseyborn (or who would not lose
their qualifications by leaving the Island), will be given
qualifications after living in Jersey 10 years. they may apply to
lease or buy.
Qualifications cannot be lost by leaving the Island.
Children who arrive in the island before their twentieth
birthday, and whose parent(s) who would lose their qualifications
by leaving the island will be given qualifications after living in
Jersey for 10 years.
Qualifications will be lost if they leave the island for a
period of more than 5 years. However, if the parents stay in the
island, children can come and go as they wish without losing
qualifications.
NB> This regulation was changed in October 2005. There are
still people in the island who arrived after their twentieth
brithday. These people would haev been able to obtain
qualifications under the previous law. They may still do so s long
as they were living in the island on or before 12 October 1995.

people who have rented with consent for 10 years (usually under
1(1)(j) - Regulation - 1(1)(e)
Essentially employed - Regulation1(1)(j)
Consents for economic or social reasons - Regulation 1(1)(k)
(consent to buy only)
Spouses of qualified people - Regulation 1(1)(n)
Consents in unusual circumstances - Regulations 1(1)(b),
1(1)(c), 1(1)(I), 1(1)(m)
